This post provides you a short info to probate law. Probate is the legal process of distributing the property of a dead person. Once a certain individual dies, probate is undertaken so that his properties can be transfered to other people. His will should be proved and validated by the court.
The court should be convinced that the decedent was on mental capability when he wrote the will, that there was no foul play involved, that it was written without any pressure and that the will is updated. The death certificate and the will should be presented in the court with certain fees. The probate court will assigned a will executor or an estate administrator to do some functions so that everything goes in the right direction.
The probate law focus on the following aspects: Once the probate case is conceded, decedent’s property in inventoried, debts and taxes are paid. The remaining property is distributed to the decedent’s beneficiaries, either as instructed in the will or according to the laws.
It is often a time-consuming and confusing process for those who are involved. Since probate is rarely easy, a guidance from individuals/company with a capable knowledge and understanding of the process can decreased stress and increase your confidence that everything goes on properly.
